Terms & Conditions

Free wireless internet (Free WiFi) is provided by the Zoological Parks and Gardens Board of Victoria (Zoos Victoria) at Healesville Sanctuary, Werribee Open Range Zoo and Melbourne Zoo. Access to and use of the Free WiFi is subject to these Terms and Conditions, which may be updated at any time. As you are bound by these Terms and Conditions, you should review these Terms and Conditions before each use of the Free WiFi.

If you do not agree to these Terms and Conditions then you may not access or use the Free WiFi.

Reliability of the Free WiFi

Zoos Victoria will take reasonable steps to provide reliable, secure and stable access to the Free WiFi but, subject to the Statutory Guarantees referred to below, does not guarantee that the Free WiFi will be continuous, fault-free, secure or accessible at all times. Zoos Victoria will not be liable if access to the Free WiFi becomes unstable, unsecured, slow or unavailable for any reason whatsoever.

Zoos Victoria advises that the Free WiFi is not suitable for supporting any application or use which requires continuous, fault-free network connectivity or uninterrupted data traffic flow.

If you are in the process of downloading a file and lose connection to the Free WiFi, your partially downloaded file will be lost. We encourage you to save your work regularly while using the Free WiFi, and take precautions to prevent loss of information.

Zoos Victoria will take reasonable steps to monitor and attend to any faults, malfunctions or other problems associated with the Free WiFi but, subject to the Statutory Guarantees, will not be liable if such faults, malfunctions or problems occur, and shall not be obligated to rectify any such faults within any specified timeframes.

User obligations & limitations

The Free WiFi is intended to be used in a fair and appropriate manner. Zoos Victoria may, at its discretion, block or limit access to certain websites, services and/or content that you may seek to access while using the Free WiFi.

This includes but is not limited to websites, services and/or content that:

could cause Zoos Victoria to be in breach of any law, or any code or instrument which governs its conduct or to incur a liability to any third person or entity;
could interfere with the integrity and/or performance of the Free WiFi or Zoo Victoria’s other networks or equipment;
contain any viruses, malware or other computer programming routines that may damage, modify, delete, adversely interfere with, or access without authority any Zoo Victoria system or data (including any personal information);
provide access to, create, store, distribute or display offensive, pornographic or illegal text, graphics, audio or video;
are used for online gambling;
promotes an illegal or unauthorised copy of another person's copyrighted work (including but not limited to file sharing applications such as peer to peer applications);
are used to harass or attempt to harass other people;
are offensive or promote racism, bigotry, hatred or physical harm of any kind against any group or individual;
promote conduct that is abusive, threatening, obscene, defamatory or libelous; or
further or promote any criminal activity or enterprise, or provide instructional information about illegal activities, including but not limited to making or buying illegal weapons, violating someone’s privacy, or creating computer viruses or malware.

You must comply with all directions issued by Zoos Victoria relating to use and access to the Free Wifi.

Security

Zoos Victoria will use reasonable endeavours to make sure access through the Free WiFi connection is secure, however we cannot guarantee the security of the Free WiFi at all times.

You are solely responsible for any information or data uploaded, downloaded or otherwise communicated using the Zoo’s Free WiFi, and are responsible for keeping all user names, passwords and other security-based information secure and private at all times.

Zoos Victoria strongly recommends you install a personal antivirus and firewall on your wireless enabled device to block unwanted traffic and potentially malicious files.

Privacy

By accessing and using this Free WiFi you agree that your email address and name will be added to the Zoos Victoria email database. You may receive email news, events and special offers as part of this and you are able to unsubscribe at any time.

Zoos Victoria will only collect, use, hold and disclose your personal information in accordance with applicable legislation, these Terms and Conditions and Zoos Victoria's privacy policy which can be accessed at http://www.zoo.org.au/privacy. This policy may be updated from time to time.

Zoos Victoria not responsible for the collection, storage, disclosure or use of your personal information by any third party (including but not limited to any website that you access and/or use through the Free WiFi). You are solely responsible for reading the terms of use and privacy policy of each website you visit, after which it is at your discretion if you continue to view that website.

Limitation of Liability

Your use of the Free WiFi under these Terms and Conditions may be subject to certain guarantees, warranties, terms and conditions imposed by the Australian Consumer Law set out in the Competition and Consumer Act 2010 (as may be amended from time to time) which that law expressly provides may not be excluded, restricted or modified (Statutory Guarantees). Nothing in these Terms and Conditions excludes, restricts or otherwise modifies the Statutory Guarantees.

Subject to the Statutory Guarantees, your access to and use of the Free WiFi is entirely at your own risk and Zoos Victoria makes no warranties or representations as to the accessibility, security, stability or reliability of this Free WiFi. Zoos Victoria specifically disclaims any liability or responsibility for any faults, failures or interruptions or the accuracy, timeliness, completeness, security or reliability of any communications (including, without limitation, any transactions) made using the Free WiFi.

Subject to the Statutory Guarantees, Zoos Victoria:

is not liable for any direct, incidental, consequential, indirect, or punitive losses damages or any loss of profit, revenue or data arising out of your access to, or use of, or inability to use or access, the Free WiFi for any reason whatsoever, even if Zoos Victoria has been notified or advised of the possibility of such damages;
assumes no responsibility, and shall not be liable for, any damage to or viruses or other harmful code that may infect your computer or mobile device or other property on account of or in connection with your access to or use of the Free WiFi; and
is not responsible for the content of any website accessed or used via the Free WiFi.
